Manufacturing activities such as cultivating marijuana, mixing chemicals, operating a drug lab, or cooking methamphetamine, is prohibited in the state for someone without the licenses to do so.

  • Drug Delivery, Distribution, or Trafficking

    A person may be facing drug delivery, distribution, or trafficking charges in Pennsylvania if there is considerable evidence that the person was involved in transporting or selling an illegal drug or controlled substance without authorization.

  • Possessing with the Intent to Deliver (PWID)

Drug Schedules

  • Schedule IV: Drugs with a lower potential for abuse than Schedule III drugs. They include stimulants and depressants, such as Xanax and Valium. They are permissible for medical use.
  • Schedule V: Substances that have an even lower potential for abuse. They are accepted for medical use. They include Robitussin AC, cough syrups, and Phenergan with codeine.

Penalties for Drug Possession in Pennsylvania

According to the Pennsylvania Health and Safety Code, Title 35, Section 780-113, the criminal penalties for drug possession will depend on the type of drug, quantity found in the defendant’s possession, and the number of previous violations.

  • First Offense: Misdemeanor charges, punishable by a fine of up to $5,000 and up to one year in jail.
  • Subsequent Offense: Misdemeanor charges, punishable by a fine of up to $25,000 and up to three years in jail.
  • Possession of Drug Paraphernalia: Misdemeanor charges, punishable by a fine of up to $2,500 and up to one year in jail.
  • Possession of a Small Quantity of Marijuana: Misdemeanor charges, punishable by a fine of up to $500 and up to 30 days in jail.

Penalties for Drug Manufacturing

Drug manufacturing charges can carry a fine of up to $25,000 and prison sentences of between one to three years.


However, the manufacturing of methamphetamine is charged as a felony and carries a penalty of a fine of up to $100,000 and up to 10 years in prison.
